HOUSTON, TEXAS — Gabriel Cornejo, 45, is going through a brutal court battle with an ex-girlfriend and the state. The thing is this: he’s not the child’s biological father, nor is he the child’s stepfather since they were never married. Mind you, he’s currently married.
According to New York Post, in 2003, a child support court in Texas ruled that Cornejo had to pay child support to his ex-girlfriend. The source says she had recently given birth to the child at that time and “vowed” there was no way he couldn’t be the “rightful” father.
Well, it seems there was a way after all.
A paternity test…
The New York Post reports as follows.
“Cornejo, who is currently raising three children of his own and two nephews, claimed he was not made aware of this and only found out about the child support payments last year when a deputy served him with court papers claiming that the state of Texas lists him as having another child. He soon met the minor for the first and only time — describing her as a ‘wonderful girl’ — but after taking a DNA test, learned she was not his after all.”
Naturally, that’s where the case should have been quashed, right? Nope! He’s still held accountable for the $65,000 in backpay!

***In this case, that makes two of us, honestly. How in the heck do they expect him to pay for something that isn’t his, that he never possessed or produced, and who he’s only seen once in his life?
I mean, sorry to ask it like that. It is a child … well, a teenager now, actually. But d**n. Come on!***
But, it’s legal in Texas…
According to New York Post — moreover, Texas’ family code, chapter 161 — even though Cornejo isn’t the child’s biological father, he still owes payments which accrued before his paternity test proved the child wasn’t his.
Carel Smith, his ex-girl’s attorney, mentions that Cornejo didn’t do anything about this when money was garnished from his account years ago. She says, since he didn’t contest the garnishment, it proves he knew about the situation and chose not to handle it — allowing it to accrue to the $65k it is today.
Smith told local news that, “even if you don’t do anything…there can be consequences.”

According to Fox-8, Cornejo’s attorney — Cheryl Coleman — notes as follows.
“There were three garnishments of $31 each when he worked at a dealership. He’s never gotten a letter from the state of Texas. At issue is he’s still not the father. Nobody is disputing that. The mother is not disputing that.”
Cornejo and Cheryl Coleman are attempting to convince a judge to reopen the case. The New York Post reports that, if they can’t, Cornejo must pay the cash or face jail time.
Absolutely wild, right!? Smh. Good luck, Cornejo. Going against the state, you might need all you can get.
